Judge Jeanine Pirro on the Death of Michael Jackson
Los Angeles detectives along with federal drug agents have executed a search warrant at the Houston office of Michael Jackson's "personal physician," Dr. Conrad Murray, in search of evidence "of manslaughter." Make no mistake, this is serious. In order for a judge to sign a search warrant, there must be reasonable cause to believe that a crime has been committed, and that evidence of that crime will be found in a particular location.
My guess is that the toxicology tests are back and that neuropathologists have identified the manner of Michael's death. Instead of 'deferred', I suspect the cause of death is listed as an overdose and possibly 'homicide.'
If Michael died of an overdose of propofol, also known by its brand name 'Diprivan', the doctor who administered it has some explaining to do. This powerful drug causes the respiratory system to suppress, lowers blood pressure, and can cause the heart to stop. This might explain the initial 'cardiac arrest' diagnosis.
Because of the potential life-threatening side-effects, propofol is commonly administered by anesthesiologists in hospital operating rooms where resuscitation equipment is required to be immediately accessible. Ironically, as it is generally not prescribed, and is rarely abused because it's only used in operating rooms, propofol is not even scheduled as a controlled substance under federal law.
If Jackson's doctor is charged with manslaughter it will be a watershed event, not just in pop culture, but in the practice of medicine as well. No longer will doctors feel free to prescribe medications to the highest bidder. They will actually have to meet with, and even examine patients to determine the need for medication. In addition, they will not be as free to mask prescription recipients by writing them in other names to circumvent federal regulations. Doctors will also be forced to recognize the necessity of obtaining the required DEA registration number in every state in which they practice, which will allow them to legally prescribe and administer controlled substances, such as Demerol and Oxycontin.
And it gets even worse. In addition to doctors, pharmacies will also be under a microscope. It has been reported that Michael Jackson had a house account at his local pharmacy that ran $50,000 a month. Unless Michael was investing in Q tips or band-aids, any pharmacy should have stopped the delivery of drugs irrespective of the number of names (aliases, obviously) for whom the scripts were written.
Dr. Conrad Murray will have to explain where he got the propofol from, and he has many questions to answer:
Why did he wait 30 minutes to call 911?
Why did he perform CPR on a bed instead of the floor?
Why was he spending the night at Michael Jackson's home?
Why did he "not know the address" where he was staying?
Why did surveillance videotapes in the house disappear?
Why were there oxygen tanks in the bedroom?
What did he do for $150,000 a month? (his lawyers said the concert promoters owed him for 2 months work - $300,000).
Why did he disappear from the hospital?
Why did he not get a DEA registration number so that he could legally prescribe medicine to Michael as his "doctor"?
Is the statement that he "did not give Michael any drug that SHOULD cause his death" an admission that he gave Michael drugs?
If more than one doctor is found to be responsible for the apparent overdose (intentional, reckless, or otherwise) of Michael Jackson, they should be prosecuted. We rely on the expertise of doctors to help us and to heal us. Indeed, doctors actually take an oath to do so, and many of us do not even question a doctor's opinion, thinking they would never do anything to hurt us.
No one is suggesting that anyone intentionally took Michael's life. But to be held accountable for manslaughter under the California Penal Code, the intent to cause death is not required. Instead, the crime of manslaughter is perfected when an individual commits a lawful act without due caution and circumspection, or when they commit an unlawful act, which brings about the death of another. Therefore, if one of Michael's doctors did not take the proper precautions, or if they prescribed medication to Michael without being legally licensed to do so, which caused his death, they have committed the crime of manslaughter.
Notoriety and access to wealth can be quite seductive. But when a licensed medical doctor delivers drugs upon demand, he is no different than any street corner, low-life drug dealer. In fact, he's worse because we trust him.

Long time lurker, thought I would say hello! I really dont post much but thanks for the good times I have here. Love this place..
When I was hurt in that boat accident my life would be changed for all time. Unfortunately that driver had no car insurance and I was going to be in pain for ever.

I think that his doctor should go to jail for what he did,and to top it all off,why in god's name did he bring his son into the room when Michael was giving all that powerful stuff? Even though Michael was addict to the drugs people was giving him,he'd had the right to say NO!.All he wanted was the money and that's what he wants.You can't bring him back.MIchael is dead and gone all because of Him.The US need more people like you to help with the Law.

I'm formerly from Westchester County, NY and remember you from your days there as a prosecutor. I've grown to be a huge fan of your show, and appreciate your clear and concise analysis of the law, your humane approach to the people in your court, and your "no nonsense" answers to the litigants. Your analysis above is just another reason why the US needs more people like you in our legal system. The irresponsibility of doctors who sell their services to the highest bidder, knowing those services to be (if not illegal) at best immoral and a clear violation of their Hippocratic oath... is beyond the comprehension of most of us.
