Judge Jeanine Pirro on the Tragedy of the Jaycee Lee Dugard Story
The tragedy of the Jaycee Lee Dugard story is that it could have been prevented. The case of an 11-year-old girl kidnapped and forced to do the unspeakable, impregnated as soon as her little body is capable, speaks to an issue that I have long fought for - civil confinement of sexual predators.
The outrage our nation is feeling is one shared by prosecutors and victims' families on a daily basis. The issue is clear: a sexual predator does not change. He (almost always a male) prefers violent sex. If he is a pedophile he prefers sex with children period! There is absolutely no way to stop him.
I have been on the front lines and in the trenches fighting these predators for three decades. We cannot change them and we cannot talk them out of it and we cannot rehabilitate them. Unless we chemically castrate them (with Depo-Provera and other such drugs), these perverts will live to find another victim - as Phillip Garrido did.
There is enough shame to go around here. What was the parole officer doing? Did he search Garrido's home, as he had not just the right, but the obligation to do? What about the police officer who dropped the ball when a neighbor complained that there were children in the back yard? Everyone knew Garrido was a sexual predator, yet the cop says he did not have access to the database showing Garrido was a sexual predator. Hogwash! He is a cop. If he is not up to the job get rid of him!!
The only answer is civil confinement where the state analyzes the danger that a predator poses and then civilly commits him. These recidivists need to be separated from the rest of us and medicated. Serving prison time is not enough because they get released - as Garrido did.
Sexual predators are the most devious and cunning of all criminals. They spend their lives targeting and stalking their next victim. We have no choice but to confine them in a secure hospital after they serve their time so that they cannot repeat their crime. This is not double jeopardy. The United States Supreme Court has said it is not and in fact has recognized that it is the obligation of a civilized society to protect the vulnerable.
I fought for a civil confinement law in New York - even taking a wagon full of thousands of petitions to the New York state legislature. I testified of the horrors that victims face from those who are our "next door neighbors" and "regular guys." It took years to pass, but it is now the law in the state of New York.
Children need our protection. Every state in this nation needs a civil confinement law. Unfortunately the Contra Costa County sheriffs and Garrido's parole officer have proven we cannot rely on law enforcement to monitor these monsters.
There is only one way to keep child molesters from our kids - civilly confine them after they served their jail sentence. Jaycee Lee Dugard deserved better. We were more concerned with feeling sorry for the criminal (letting him out of prison early) believing he was rehabilitated. It is time we started protecting the people who pay the ultimate price for our wanting to believe that the criminal is "all better".
It is time we protect the Jaycee Lees of our society and punish the Phillip Garridos.

Sounds like you're only interested in a 'clean sweep' of all sexual predators. I understand your point and position on this. But are they all the same? And, 'civil confinement?'
For violent offenders, including those who would kidnap a child, rape and then keep them sequester them for years impregnating them; definitely, that person and others who commit such acts must be confined. One gives up their right to live a free, unconfined life, in my humble opinion, after such atrocious acts.
I cannot fathom how Ms. Dugard survived for those 18 years and maintained the mental clarity to then escape.
But to confine everyone, is a mistake. I know a young man, who, in his twenties, exposed his buttocks to children on a playground several times. He was finally found out and arrested, and is now must register with the respective jurisdiction's sex offender registry. I've known him since he was four years old. I know what happened to him. Must he be confined as you say, and subjected to the same treatment as a violent sexual offender? We would be making a great mistake as a society by forcing those who are not violent offenders to submit to civil confinement in a hospital for the rest of their lives. Have you forgotten about the institutionalization of the mentally ill? How about when having syphilis back in the 19th century was grounds for commitment? The sweeping generalization you express is disappointing to me. I followed your campaign for senator of NYS. I even sent you a cd and letter when you lost.
Throwing the baby our with the bath water, to reiterate an old adage, has never worked. You must know that. Enough said.

It is always hard to hear these stories. We often live in a life that we think others are not living only to find out that others are living our same life only with a different characters.
When I was about to turn 15 I finally turned us in to the Childrens Service Board (CSB). I was a bit surprised when the gentleman who took the call stated our father had called CSB to tell then his children would probably call with a story about being molested. I asked him how silly this sounded and how smart did he appear to believe a man would call to warn them. In any event, all eight of us were removed on my mothers birthday. She still blames me for "ending my marriage." I feel sorry for both my parents. My mother who closed her eyes to what was going on so long as he did not bother her and my father for thinking it was our fault.
In this day and age, it is up to those of us who have been through this to educate the world. Too many children's minds are raped as well as their bodies while other adults look away. I turned in a family member whose child was being abused and everyone was mad at me. I have decided that when it comes to my relationship with adults and my need to protect a child that I have to make sacrifices. I decided the adult is worth the sacrifice for there comes a time in our lives when we have to attempt to wake up and take responsiblity for our actions and those of others around us, if it s causing harm to the defenseless, should be pointed out to the authorities.
We are in a situations we continue to use as a crutch. Our children are there because of our choices and the fact that we close our eyes. Wake up everyone...if we don't, who will protect your child.
What can be done to curb these nasty, and unforgivable crimes against our nations' children? All I can say is 'Thank God' for the Amber Alert System, which gives all drivers on our nations' roadways a quick description of a perpetrator intent on completing this disgusting crime. Granted, these crimes still happen, but the AAS, is a big step in the right direction. Our Judges need to take a stronger stance on these criminals. No plea deals, no leniency for information on the crime, no more letting them off easy, etc. I turn my head in shame at some of the sentences handed-out by Judges. We need to remove these Judges who are directly responsible for some of the dead children laying cold, in our morgues. We all suffer when these crimes occur, but the children need the most protection, and it's up to us to give it to them.
Confinement is the only real solution, castration or chemical castration cannot control the physical or emotional abuse and power and control that they can still wield against their victims.
I was abused by my biological father from the time I was 5 till I was 17. I knew there was no help from my family or teachers. I was the adult in the household staying away as much as possible. I got away at 17 and finally for good at 19. It still affects my life today. Now I an turning 60 have three marriages, two children, four grandchildren. I have coped as best I can, but there is long term depression and am alientated from both sides of my parents family. Speak out to any and all, even if they do not hear.

There were three other girl's also at diffrent time's, My Daughter was the best Little girl, untill this happen in the teacher's lounge, It took my Daughter away from me, John Breedlove got 5 yrs in prison My Daughter I belive got life, from the age 13 she has turned to drugs she is now serving 5 yrs for armed robbery, she has two childrin 3 and 5 that live with my exwife,and visits me and my wife when school is out, of course the youngest ( boy ) gets to see us more because he's not in school yet. I caught my Dad molesting my baby sister when she was 3 years old. My Mom was in the hospital with a broken ankle due to Dads anger. I told him I was going to tell Mom what he did when she got home from the hospital. I was 9 years old at the time. He stated that if I said anything to anyone he would cut my f####ing tongue out. There was no doubt in my mind that he would do what he said. She divorced him when I was 13 and I told my Mom when I was 15 or 16. He also sexually abused her when she was pregnant with her first child. Sexual child abuse is a life sentence for the child. It should also be a life sentence with no parole for the abuser. I felt my baby sisters pain right up to when she passed away of cervical cancer at the age of 49. I believe he also molested me as I don't have any memories until I started school at the age of 6. My siblings and I were removed from our parents when I was 10. That is when I became Mom. I also caught my foster dad of molesting my sister. I knew no one would believe me as this was back in 1958. The welfare worker was coming to visit the next day and she always picked up my baby and put her on her lap. I told her when that happened and the lady asked her how she liked living their she had better tell her she didn't like it and wanted to live some where else. That very day my baby was removed from that house hold. I still had a younger sister and brother to take care of.
When we were all adults we all had an alcohol problem. Both parents were chronic alcoholics. As the years went by my Mother had the gall to blame my sister. All my baby wanted was for her Mother to say the words I love you to her. She never heard them. Instead she heard that Mom never wanted her in the first place.
I think the government should put all predators of any kind and put them on a deserted island and let them rape and murder each other. Why should the public pay for these monsters to be imprisoned? Also, I believe when they go to prison, they should let them out in the yard and they will be rightously taken care of by other inmates. Save the tax payers some money.

remember the guys get more time for have sex with a child then killing i know i have a friend that is in prison and he go 20 years and his girl friends daught was 14 and i read about a guy that was 52 that had sex with a 6 year old and got 2 years and a nother one that got 4 years and nothing is being done about it
I live in Montreal,Canada but I get to watch your show everyday, I never miss it. I'd like to say that we would need judges like you in Canada. it saddens me when sexual predators get released out of jail after they're " cured". I know that rapists and child molestors get beaten up in prison but still.
They should get castrated so that they won't be able to do these kind of things anymore to innocent children.

We need more Judges like you. Thank God for you. I watch your show every day. You are a kind and loving person. I am 64 years old, I remmber my old grandie telling me that in the years to come its going to bad people so grand child you watch your back. I see what my grandie was talking about. My heart gos out to all childerns that are molested. Thats why i talk to all of the childerns in my family telling them that they can come to me and that they can talk to me about anything thats on there minds anything. I always tell them how much i love them,that they can trust me no matter what. I will take care of what going on in there lifes. I will give my life for a child. People we are not telling our childerns how much we love them. We need to tell them every day that we love them. Just like you love being told that you are loved they need to hear it too.
They will feel that they can come to you with whats on there little minds,if any thing is happening to them they can express it to you.

you never get over.I thought that when a rapeist
moved in your area they are suppose to let people
in the area know.We have one that lives down the
street .The only way I found out is looking on the internet under sex offenders.He lives with a
lady with children.I thought they were not to be
within a household where children live. What is wrong with our law ?
I was once, in almost, the same situtation, as Deborah Davenhill, with a Child Molester, but I wasn't married to Danny Pevehouse, from April 2004, till, October 2005, because I wasn't able to leave Hart, Texas, since, he filed court papers, and we both had to sign a paper, so, we can leave. I got him to sign a paper, to let me leave, and come back to Tucson, Arizona, where my family, and friends are, but I had to do, and say what he wanted, at all times, no matter what, which, makes me sick to my stomach of the things I had to do, because I was in a prison, it's such a little town, without any transportation at all, unless, you knew someone with a car, I was terrified for all of us, my daughter, Piper, we had together, my son, Stefan, my other daughter, Rosalie, and myself, my other son, Jonathan, got out of there, as soon as his baby sister was born, he was the lucky one of us, since, Danny is a very violent person. We had stayed in a domestic violence shelter, there, and everyone knew about him, but no one had told me, which, I think they're, just as much, as fault, as he is, and I think more so, in a way, because I would of gotten away from him, before he was able to take my Baby Girl, Piper, away from me, because he has money, cunning, he's devious, charming, a lier, an animal killer, an abuser, and makes me, look like I'm crazy, when I have proof, that, I'm not, from a therapist, that, I've been seeing, to get passed, what he's put us all through. I got to see my Baby Girl, Piper, a couple of weeks ago, after 2 years, when they took her, from me, when we were in another domastic violence shelter here, to get away from him, again, and only for a few hours, but I had to send him money, which, I had no problem with that, so, I can see my daughter, he even tried to make me look bad, in my Mom's eyes, which, didn't work, since, my Mom knows me to well, and knew he was just trying to make himself look good, because of Danny, I had to do, and say what he wanted, as usual, and I've had to keep my mouth shut, otherwise, he won't let me talk to her, email her, and see her, like the past 2 years. The court gave him, the exclusive right to designate the primary residence, of where she lives, which, I can't go to Hart, Texas, alone, otherwise, he'll kill me, like he said he would, several times, but we're both Joint Managing Conservators, and I still can't say anything, I have to keep my mouth shut, otherwise, he acts like a child, and cuts me out of my daughters life, and I've been trying to get full custody of her, because I already know he's doing something to my Baby Girl, Piper, by signs, since, I was molested as a child, and it states in the court papers, about sex offenders, which, he has to register every year, on his birthday. I've tried getting a Lawyer, and no one will help me, I don't have the money, I tried Pro Bono Lawyers, I even tried Legal Aid in Plainview, Texas, and here in Tucson, Arizona, without any luck. I've called C.P.S. here, and in Texas, but no one is lissening, and it kills me inside, knowing I can't do anything, because it's not their child, and they don't care. I sent a bunch of paper work, to the Judge in Dimmit, Texas, and got no response, what so ever. I even contacted, Ray Tomaselli, from Child Find of America, and he wrote a letter to the Judge to reopen the case, but he got no answer, and nothings being done to help my Baby Girl, Piper, from her Father, the Monster. Is there anyone out there that can help me or knows anyone that can help me? Thank You!

Judge I am a Canadian and I agree with you wholeheartedly. I think this should be the protocol for the whole world. If this law was in place for all the USA or/and Canada, who stops the predators from other nations from entering our country and molesting, raping or murdering. The citizens of our countries are the ones to be protected. Lock these molesters, rapist and murders away and keep the public safe.
I agree with you that rehabilitation doesn't work for all; well for most. I do not believe that all sex offenders should be civilly confined. I'm really only referring to cases of 18 yr old girls/boys being charged as sexual offenders for having a 16 or 17 yr old boyfriend/girlfriend.
Dear Judge Pirro, I truly believe that what you have stated is true! I was once unfortunately married to a child molester. He was jailed for molesting my daughter (his stepdaughter) and was supposed to get treatment and mental rehab while confined in prison. However, about 4 months after he was imprisoned, they informed me that they were not going to bother with the mental health treatment after all. When I asked them why they had changed the sentence, they told me that "the panel" had decided that giving people like him treatment was a waste of time and money and that predators of his type had a recidivism rate of something like 95%. I then gave up hope and started divorce proceedings. After he got out (after only 18 months) he continually tried to get in touch with my daughter (and me, which I'm sure was just to get to her) and would call our home send her Christmas and birthday gifts and cards, etc. when he didn't even send his own children anything (not even child support!). We finally moved far away, but get this: I heard he got married later, and their first child was a girl, and he named her my daughter's name! It gave me the creeps! He never got caught and never paid child support for his FOUR children, and I had to raise them totally alone, including finacially, their entire lives! The daughter he molested, who is now 39, has had a very rough life, acting out, including drug use and promiscuity, even though she had extensive therapy, and is just now seeming to be sorting her life out! So I KNOW the heartbreak this causes, to so many people in the whole family and even the extended family and friends, and for LIFE. I agree wholeheartedly with you that these predators should be confined for life and never let out again. I am crying as I write this because just the memories and pain of the whole thing comes back to hurt me even now, some 25 years later. I wish and pray that this law will be passed in my lifetime!!! Love you, Judge, and I'll keep watching on TV and rooting for you!
I couldn't agree more. The child molester will molest again, the rapist will rape again and the murderer will murder again. We need to recognize that rehabilitation will never work for these offenders. It's time to pay more attention to the civil rights of the victims instead of the offenders. In fact, I think we've lost sight of what that term actually means.
