"Finally Protection for the Innocent"

The Supreme Court ruled this week in United States v. Comstock, that federal officials can indefinitely hold inmates who are considered to be "sexually dangerous" even after their prison terms are complete. The justices, voting 7-2, ruled that Congress acted within its constitutional authority in enacting the 2006 law, part of the Adam Walsh Child Protection and Safety Act, which affects people already in federal custody. State civil confinement laws, however, remain unaffected.

The Supreme Court, in ruling as it did, accepted the argument made by Solicitor General Elena Kagan, which compared the government's power to commit sexual predators to its power to quarantine federal inmates whose sentences have expired but have a highly contagious and deadly disease. I couldn't agree more with this argument.

I have been on the front lines and in the trenches fighting sexual predators for three decades. I fought for a civil confinement law in New York - even taking a wagon full of thousands of petitions to the New York State Legislature. I testified of the horrors that victims face from those who are our "next door neighbors" and "regular guys." It took years to pass, but it is now the law in the State of New York.

A sexual predator does not change. They are the most devious and cunning of all criminals. They spend their lives targeting and stalking their next victim. They prefer violent sex, and if they are pedophiles, they prefer sex with children. We cannot change them and we cannot talk them out of it and we cannot rehabilitate them. Unless we chemically castrate them (with Depo-Provera and other such drugs), these perverts will live to find another victim. There is absolutely no way to stop them.

Civil confinement is the only answer. These recidivists need to be separated from the rest of us and need to be medicated in a secure hospital after they serve their prison time so they cannot repeat their crimes. This is not double jeopardy. The United States Supreme Court has said it is not and in fact has recognized that it is the obligation of a civilized society to protect the vulnerable.

I argued months ago that serving prison time is not enough because the predators get released. Phillip Garrido, the man alleged to have kidnapped and committed unspeakable sexual acts against 11-year-old Jaycee Lee Dugard, should have been civilly confined.

It's time that those 30 states without civil confinement laws follow in the footsteps of the Supreme Court and protect the Jaycee Lees of our society and punish the Phillip Garridos.

If they served their time in prison as sentenced by a Judge then they need to be let out. Holding them beyond that is cruel and absurd. You are in no place to say that there is absolutely no chance for them to be rehabilitated (as if anyone actually tries to rehabilitate anyone in prison).

If you want to keep someone in prison for the rest of their life or until they are appropriately rehabilitated then sentence them for life pending parole.

I understand the need to protect the vulnerable society that is obeying the laws but if they plan on holding someone past their time, they obviously didn't give them the right sentencing.

We need you desperately in VERY high public office, Judge Pirro. Common sense is sorely lacking at all levels today.

Dear Judge Pirro,
I was just watching your show regarding the young lady who was molested by her father and mothers boyfriend,(May, 2 2010)and you stated to her to leave the forgiveness to God and she shouldn't forgive them. As an individual who was repeatedly molested by the male members of her family, a nieghbor and than raped by two teenage boys do not agree with this statement.
I have had the ability, after many years of guilt and shame, to work on my on my own issues have found that the forgiveness that I have given to each of them has nothing to do with them, it has to do with myself. It is so I can get on with my life and not continue to carry the guilt and shame that we as victoms carry. I do not like what these men have done or who they represent as human beings, but as children of God, I love them. This does not mean that I have a relationship with them, although I do know of women who can do that today. I ask that you resend that statement so others will understand it's not about the people who do the molesting, it's about coming to terms that when we carry feelings of hate for them we are only hurting ourselves.
