In today's case, the Plaintiff did a great job producing evidence to prove his claim, and interestingly the Defendant corroborated the Plaintiff's allegations. I introduced a term in today's show called Prima Facie -- the term is of Latin origin and the literal translation is "at first sight."

It means, once the plaintiff proves all the elements in his cause of action it is then up to the Defendant to prove otherwise. Essentially, unless that evidence is contradicted by the defendant, the plaintiff has met his burden of proof.

The Plaintiff in this case provided everything to prove his case then it was the Defendant's burden to prove that the Plaintiff's evidence was insufficient. If the Defendant had said, "this is not my phone number" the burden of proof would have gone back to the Plaintiff. As I suspected, the Defendant did not refute any of the Plaintiff's evidence therefore the Plaintiff met his burden of proof and he prevails.
